By accessing or using the No Gum website, placing an order, or purchasing any product from us, you agree to this Website Use, Third-Party Fulfillment, and Purchase Notice, as well as our Terms of Service, Privacy Policy, Shipping Policy, and Return Policy, all of which are incorporated by reference.
1. Seller of Record; Third-Party Fulfillment
No Gum sells products through this website and may use independent third-party service providers to print, manufacture, process, package, fulfill, and ship orders on our behalf. These providers may include print-on-demand partners, payment processors, shipping carriers, fraud prevention vendors, and related operational vendors.
By placing an order, you acknowledge and agree that No Gum may share order details, shipping information, and other information reasonably necessary to process, fulfill, deliver, support, and protect your transaction with such third-party providers, subject to our Privacy Policy and applicable law.
2. Product Display; Variations
We make reasonable efforts to display our products as accurately as possible. However, you understand and agree that actual products may vary slightly from digital previews, mockups, or on-screen images, including with respect to color, scale, print placement, garment texture, trim details, and minor production differences.
Minor variations that do not materially affect the use, appearance, or value of the product will not be considered defects.
3. Order Acceptance; Availability; Cancellation
All orders are subject to acceptance, availability, and verification. We reserve the right, in our sole discretion, to refuse, limit, cancel, or refund any order at any time for reasons including suspected fraud, pricing or listing errors, inventory or production limitations, suspected abuse of our policies, or other legitimate business or legal reasons.
If your order is canceled after payment has been processed, we will issue a refund of the amount paid for the unfulfilled portion of the order.
4. Pricing; Listings; Site Errors
We strive for accurate pricing, descriptions, availability, and listing content, but errors may occur. We reserve the right to correct any errors, inaccuracies, or omissions at any time, including after an order has been submitted. We may cancel affected orders and provide an appropriate refund if necessary.
5. Shipping; Delivery Estimates; Delays
Any shipping or delivery timelines displayed on our site, in marketing materials, or in order communications are estimates only unless expressly stated otherwise. Production and shipping times may vary based on demand, seasonality, carrier operations, weather, supply disruptions, customs, force majeure events, and third-party fulfillment delays.
You acknowledge that third-party printers and carriers are independent entities whose operations are not fully within No Gum’s control. However, if we cannot ship within the time stated at checkout or otherwise promised, we may contact you regarding the delay and provide options as required by applicable law.
6. Address Accuracy; Returned or Undeliverable Orders
Customers are responsible for providing complete and accurate billing and shipping information. No Gum is not responsible for delays, losses, or additional costs resulting from an incorrect, incomplete, outdated, or undeliverable address supplied by the customer.
If an order is returned to sender due to customer-provided address errors, failed delivery attempts, or refusal of delivery, we may, in our sole discretion, offer reshipment at the customer’s expense, issue store credit, or deny reshipment or refund except where required by law.
7. Delivered Packages; Carrier Issues
Once an order has been transferred to the carrier, delivery events, scans, and tracking updates are generated by third parties. No Gum is not responsible for carrier delays, missed scans, or events occurring after the carrier takes possession of the package, except as otherwise required by law.
If tracking reflects that a package was delivered to the address provided at checkout, claims for theft, loss after delivery, or package retrieval issues may be denied or resolved in No Gum’s sole discretion, unless applicable law requires otherwise.
8. Damaged, Defective, Incorrect, or Materially Misprinted Items
If you receive an item that is damaged, defective, incorrect, or materially misprinted, you must contact us at supportatnogum@gmail.com within 7 days of delivery and provide your order number, a description of the issue, and clear supporting photos.
All such claims are reviewed on a case-by-case basis. If No Gum determines that the item is damaged, defective, incorrect, or materially misprinted, No Gum may, in its sole discretion and subject to applicable law, provide one of the following remedies:
- replacement of the item
- store credit
- refund to the original payment method
- another commercially reasonable remedy
We reserve the right to request additional information, require return of the item, request destruction confirmation, or deny a claim that is unsupported, untimely, abusive, fraudulent, or based only on minor variations inherent in the production process.
9. All Sales Final
Except as expressly stated in our posted policies or as required by applicable law, all sales are final. No Gum does not accept returns, exchanges, or refunds for reasons including change of mind, buyer’s remorse, ordering the wrong size, ordering the wrong color, dissatisfaction with minor print or garment variations, or other preference-based reasons.
10. Third-Party Services Disclaimer
The website and the purchase experience may involve third-party platforms, payment processors, printers, manufacturers, software providers, logistics providers, and carriers. No Gum does not control and is not responsible for the acts, omissions, downtime, service interruptions, delays, policies, content, or independent conduct of third-party services, except to the extent liability cannot be excluded under applicable law.
11. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and all content, products, and services made available through it are provided on an “as is” and “as available” basis, without any express warranties unless expressly stated otherwise by No Gum in writing.
Nothing in this Notice is intended to disclaim or limit any warranty or consumer protection right that cannot be lawfully disclaimed or limited.
12. Limitation of Liability
To the fullest extent permitted by law, No Gum and its officers, owners, employees, contractors, agents, licensors, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost opportunity, loss of goodwill, business interruption, or data loss, arising out of or related to your use of the website, your order, any product purchased, any shipping delay, or any third-party fulfillment or carrier issue.
To the fullest extent permitted by law, No Gum’s total aggregate liability for any claim arising out of or relating to the website, an order, or a product will not exceed the amount actually paid by you to No Gum for the specific product giving rise to the claim.
13. User Responsibility; Indemnification
You agree to use this website lawfully and not to misuse it, interfere with its operation, submit false claims, attempt chargeback abuse, commit fraud, or violate the rights of No Gum or any third party.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless No Gum and its affiliates, owners, personnel, contractors, and service providers from and against claims, damages, liabilities, costs, and expenses arising out of your misuse of the website, your breach of these terms, your fraud, your violation of law, or your infringement of another party’s rights.
14. Force Majeure
No Gum will not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, severe weather, natural disasters, war, terrorism, civil unrest, labor disputes, power or internet outages, supply chain disruptions, government actions, customs delays, epidemics, pandemics, carrier disruptions, or failures of third-party service providers.
